CricketSniper.com Affiliate Program Agreement
This Agreement contains the terms and conditions
pertaining to your participation as a CricketSniper.com Cricket Power
Sniper Affiliate. In this Agreement, "we" or "our"
refers to CricketSniper.com, part of Eccles Enterprises and
"you" refers to a "Cricket Power Sniper Affiliate." We
will hereafter use "you" and "Affiliate"
interchangeably. “Site” can mean Web Site, Blogging Site or any other
means of hosting a web page, forum, mailing list etc by you or somebody
else in your behalf. Site can also mean a signature email link.
1. How to Enroll in the Program
To begin, read this agreement in its entirety, read
the FAQ (Frequently Asked Questions), submit a one time processing fee of
$10 US, then complete the online application
via our site. We will review your application before accepting you into
the program. We reserve the right to reject your application at anytime
and for whatever reason we deem necessary. Possible reasons for rejection
include, but are not limited to, sites we find to contain sexually
explicit, violent, discriminatory, or illegal content. If your site is
rejected, you may reapply at any time.
Applying to the CricketSniper.com Affiliate program
constitutes acceptance of this agreement.
2. Links on Your Site
Affiliation with CricketSniper.com does not require
the ownership of a web site.
You will provide a link to our site through an
approved CricketSniper.com Affiliate Link. Additional links are those
found within the Affiliate Lounge.
Visitors to your site must clearly understand that
clicking on the CricketSniper.com-approved links will take the visitor to
CricketSniper.com.
We will provide you with technical specifications
describing how to include the links on your site. We will also provide the
graphics needed for your site. You may not represent CricketSniper.com or
use its trademarks, logos or other branding in any manner other than
providing approved links. This approved content must be kept up-to-date.
You may place links in your email signature or other
places you feel can provide good marketing method.
3. Orders and Tracking
We will be responsible for orders placed by customers
who follow links from your site to CricketSniper.com. This means we will
handle all issues pertaining to the orders that are a result of a link
from your site. This includes all customer service. We will track all
customer impressions, clicks, and sales through persistent cookie
technology. Each CricketSniper.com Affiliate Link is issued a unique
identification number that is associated with your site. You are
responsible to ensure your site is properly formatted and working.
4. Referral Payments and Product Commission
At this time the Cricket Power Sniper Software is the
only program available to affiliates.

An Affiliate will receive a 25% commission on all orders sold to visitors who are introduced to CricketSniper.com through the affiliate.

An Affiliate that refers another affiliate will be given a Level 1 commission from all sales from the Level 1 affiliate.

An Affiliate that refers another affiliate who in turn refers another affiliate will be given a Level 2 commission from all sales from the Level 2 affiliate.

An Affiliate that refers a Level 1 affiliate who in turn refers a Level 2 affiliate who in turns refers another affiliate will be given a Level 3 commission from all sales from the Level 3 affiliate.

An Affiliate site that refers a Level 1 affiliate who in turn refers a Level 2 affiliate who in turns refers a Level 3 affiliate who in turn refers another affiliate will be given a Level 4 commission amount from all sales from the Level 4 affiliate.
Affiliate sites will receive the following
commissions for products purchased through the CricketSniper.com site:
Cricket Power Sniper = 25% commission Net Revenue

Level 1 commissions are 8%

Level 2 commissions are 5%

Level 3 commissions are 2%

Level 4 commissions are 1%
Net Revenue is defined as Gross Sales minus refunds.
Refunds are a very rare occurrence because all
Cricket software offers a 15 day demonstration period. Those who make the
purchase decision are committed to doing so.
5. Payment Schedule
You will earn referral payments based on monthly
CricketSniper.com's sales, which were referred through your site. Accounts
with a minimum of $25 will have payments made each month. Affiliates are
paid on a net 30 terms.
6. Policies and Pricing
Customers who buy products through one of our
partners are considered CricketSniper.com customers. We have the right to
change our prices or policies at any time. We reserve the right to
terminate this program at any time for any reason. In the event we
terminate the program you will be notified and paid for outstanding
commissions.
Do not include price information in your link to
CricketSniper.com, as we cannot guarantee a certain price for products.
7. How to Identify Yourself as an Affiliate
We will provide a graphic image and template for your
site, and other linking options to put on your site and that identifies
you as a partner. You will need to put this on your site and make sure
that it works.
In addition, we encourage you to provide a link to
our home page at “http://www.cricketsniper.com/”
8. Limited License
You have a nonexclusive, limited, revocable right to
use our icon and other like images only for the purpose of identifying
your site as an Affiliate and to generate sales. You may not modify any of
our images without pre approval. We reserve all rights for the icon, our
trade names and trademarks. We may revoke your license at any time by
giving you written notice in the form of an email.
9. Responsibility for Your Site
You will be solely responsible for the development,
operation, contents, and maintenance of your site. We take no
responsibility for content or functionality of your site.
10. Relationship of Parties
Nothing in this Agreement creates a partnership,
joint venture, agency, franchise, sales representative, or employment
relationship between the parties.
11. Limitation of Liability
We are not liable for indirect, special, or
consequential damages (or any loss of revenue, profits, or data) arising
in connection with this Agreement or the Program.
12. Disclaimers
We cannot guarantee that our site will be
uninterrupted or error-free, and we will not be liable for any
consequences arising from any interruptions or errors.
13. Terms and Conditions
The term of this Agreement will take effect upon our
acceptance of your Affiliate application and will end when terminated by
either party. Either party may terminate this Agreement at any time, for
any reason. We may choose to terminate this Agreement if we determine your
site content is inappropriate, you have breached any conditions of this
Agreement, or if you are sending "spam" (mass, unsolicited
e-mail messages) to customers.
You are only eligible to earn referral payments on
orders purchased during the term of the Agreement. Payments earned through
the date of termination will remain payable only if the order is not
canceled. We may withhold your final payment for a reasonable time to
ensure that the correct amount is paid. Upon one-week's notice,
CricketSniper.com may change, suspend or discontinue any aspect of this
Agreement or the Service, including the availability of any Service
feature, or other content. We also reserve the right to modify any portion
of this Agreement.
IF ANY PORTION OF THIS AGREEMENT OR ANY FUTURE
MODIFICATIONS TO THIS AGREEMENT ARE UNACCEPTABLE TO THE AFFILIATE, OR
CAUSE THE AFFILIATE TO NO LONGER BE IN COMPLIANCE WITH THE AFFILIATE
AGREEMENT, THE AFFILIATE OR CRICKETSNIPER.COM MAY CANCEL THE AGREEMENT. AN
AFFILIATE'S CONTINUED USE OF THE SERVICE CONSTITUTES A BINDING ACCEPTANCE
BY THE AFFILIATE.
14. Non Transferable
The affiliation is non-exclusive and non-transferable
and permits the permits the affiliate to market the product and post links
as described in this agreement.
15. Payment Method
Payments to affiliates will be made via PayPal. Thus
you must have a PayPal account to qualify.
16. Account Maintenance
You are responsible for the maintenance of your
affiliate account information. If you fail to maintain your affiliate
account and your email address changes your commissions will be held for
up to 60 days. If your account is not updated within that time frame the
affiliate forfeits their commissions and their account will be terminated
without further notice.
17. Taxes IRS Information Returns
You are responsible for any tax
obligations as a result of this affiliation.
The IRS uses information returns to
make sure that people pay taxes on their income. The IRS computers compare
the payments shown on the information returns against people's income tax
returns to see if they included the payments in their income.
Currently the amount of commissions
paid to independent contractors that will require our company to file an
IRS Information Return is $600 on Form 1099-MISC
Form 1099-MISC contains your social
security number or Tax ID and the amount that we paid you. The IRS
compares the payment we reported on our copy of the 1099-MISC against the
your income tax return. If you do not report the income on your tax
return, the IRS will send you a letter detailing how they adjusted your
return, and how much you owe in taxes if applicable, including interest
and penalties.
You are not required to supply CricketSniper.com with
your Tax ID number (or social security number) until the $600 limit is
reached. If you do not provide CricketSniper.com with a tax identification
number as required by law at the time you reach this limit, your
affiliation with CricketSniper.com will be terminated and your current
payment due you will be forfeited.
18. Privacy Policy
Personal Information collected by us will never be
sold or given away period.
18. Venue
This Affiliate Agreement has been made in and shall
be construed and enforced in accordance with Idaho law. Any action to
enforce this agreement shall be brought in the federal or state courts
located in Boundary County.

19. Entire Agreement
This Agreement constitutes the entire agreement of
the parties and supersedes all prior communications, understandings and
agreements relating to the subject matter hereof, whether oral or written.
